The following terms and conditions have been prepared to help you make the most of The Yoga Shed Limited’s services. These terms and conditions, together with our privacy policy, constitute the entire agreement between you and us. This in relation to the services we provide when you are using our studios, attending our classes and visiting our website, and including any external event in which The Yoga Shed participates. Please read through these documents carefully.

In these terms and conditions the following definitions apply:

‘Class’ means a class or activity provided by The Yoga Shed.

‘Member’ or ‘You’ means someone who has completed our registration form, electronically through Mindbody Online or within the studio. ‘Your’ shall be construed accordingly.

‘The Yoga Shed’, ‘We’ or ‘Us’ means The Yoga Shed Limited.

‘Studio’ means the location at which the Class occurs as indicated by The Yoga Shed.

By agreeing to our terms and conditions you are granted a personal, limited privilege to enter and use our studio without prejudice to our other rights, with immediate effect if you agree with the above. Please do not use any of these services if you disagree with any of our terms.

1. MEMBERSHIP AT THE YOGA SHED

1.1 Before taking part in any class at The Yoga Shed a registration form must be completed.

1.2 Your information is held by our third party software supplier, Mindbody Online.

1.3 By completing The Yoga Shed registration whether online using the Mindbody website or at the studio you are applying to become a member of The Yoga Shed.

1.4 Acceptance of a member is at the sole discretion of The Yoga Shed

1.5 A person will cease to be a member if their membership is terminated under these terms and conditions

1.6 The Yoga Shed reserves the right to expel anyone from the premises, terminate a membership and/or refuse to renew a membership for anyone who fails to comply with these terms and conditions.

2. PAYMENTS AND BOOKING

2.1 All classes must be paid prior to taking the class.

2.2 Members are welcome to come to the studio without prior booking but your place in the class is not guaranteed until you are booked in. We work on a first come, first served basis.

2.3 Prices are listed on our website and at the studio. We reserve the right to change prices from time to time for any reason but will endeavour to give 30 days notice of any changes.

2.5 Payments for a ‘Drop in’ ‘Welcome Offer’ and ‘One off unlimited pass’ (studio & online) class can be paid for online or at the studio.

2.6 Membership Autopays can only be set up at the studio.

2.7 If attending pre and post-natal classes you can cancel your membership at any point before your Autopay renewal date.

2.8 All payments on cards will be made in pounds sterling and at the time of payment. We are not responsible for any additional charges levied by the individual financial institutions or credit card companies.

2.9 Starting a monthly membership, can be set up at any date within a month.

2.10 When buying products from The Yoga Shed, goods are returnable for refund or exchange 28 days from purchase provided that the goods are returned unopened in the same condition as when they were sold. This does not affect your statutory rights.

2.11 The ‘Welcome offer’ can only be used once and only on your first visit to the studio. Once you have paid for your first class the welcome offer is no longer available or must be taken from the date of the first visit.

3. CLASS BOOKING

3.1 Classes can, subject to availability and your eligibility to book, be booked online from up to 28 days before the class until the class starts.

3.2 Bookings can only be made online if you have an active membership or by paying for a drop in class and registering with mindbody. Bookings can also be made via email/phone.

3.3 If you book in for a class but are absent that class or the amount will be deducted from your membership account.

3.4. All members must report to reception to sign in for class.

3.5 Booking and/or signing in must be all done using your own account and membership using another members account or membership it fraud and will be dealt with accordingly.

3.6 If a member continually ‘late cancels’ a class The Yoga Shed reserves the right to remove the member from future classes.

3.7 Class sizes are limited so booking is advisable.

3.8 Cancellations made by you with less than 4 hours notice (Studio) or 2 hours notice (Online & Outdoor) or 12 hours notice (Workshops) will be charged in full. If you are unable to make a booked class, you must, cancel or reschedule using the mind body app/website or call the studio on 01462 433597 or email.

3.9 If you have paid for a single or a limited membership and you cancel more than this period your class will be credited back on to your account and can be used for a future class.

3.10 Class credits cannot be transferred between members and are not refundable.

3.11 From time to time we may host special offers or promotions, which may have different or temporary terms and conditions.

4. AUTOPAY MEMBERSHIPS

There are six types of Autopay memberships: Unlimited Combo, Unlimited Yoga,, 8 class Combo, 8 class Yoga, 4 class Combo and 4 class Yoga. The following terms apply to these types of memberships only.

4.1 Unlimited Combo means you can attend as many classes as you would like in a month and in either studio, this means if you attend on average 12 classes a month each class will cost you between £6.87.

4.2 Unlimited Yoga, means you can attend as many classes you wish in our unheated studio, if you attend on average twelve classes a month each class will cost you £5.00 per class.

4.3 x8 Combo, means you can attend eight classes in a month in either studio costing £11.25 a class.

4.4 x4 classes Yoga, means you can attend four classes a month in our unheated studio, costing £10.00 a class

4.5 If on a ‘Yoga’ membership but you wish to attend any hot/warm yoga class, you may do so for a £6 surcharge.

4.6 We reserve the right to end any membership if you fail to comply with these terms and conditions in any way.

4.7 If you wish to end your membership 30 days notice must be given in writing or email. Your membership will continue until we are notified.

4.8 Membership prices can change at any time at The Yoga Shed’s discretion. However, we will give you 30 days notice before any changes are made.

4.9 No refunds can be given in relationship to our membership deals.

4.10 If membership is paid by direct debit the member authorises The Yoga Shed to debit any credit or debit card provided by the member for the monthly membership fee (or any outstanding fee) without notice to the member.

4.11 Being a member does not reserve your place in a class. Class sizes are limited and subject to availability. You acknowledge that you will need to book in before a class to guarantee your spot.

4.12 Any lapses in membership, including late or non-payments will be dealt with individually but may lead to administrative charges.

4.13 From 1st January 2018 monthly memberships are to be taken out for a minimum of 3 months, If you wish to cancel your membership after this time, we must be given written notice at least 7 days before you wish your membership to be terminated.

4.14 Monthly Memberships can be bought for one month at a time from January 2018 onwards but will incur an extra costs.

5. HEALTH AND SAFETY

5.1 You acknowledge that you are fully aware that the participation in classes or workshops involves risks and that you accept all the risks of participating.

5.2 You affirm that you are in proper physical condition to participate in any activity associated with The Yoga Shed and its classes and are aware that there are risks in participating in any physical activity, potentially that which could result in injury, serious injury or death.

5.3 If medical care is given to you, you hereby consent to the care that is given, if you are unable to give my consent at the moment it is expedient to give it.

5.4 You are aware that it is advised to consult a physician prior to participating in or using our services.

5.5 You agree to declare all injuries, illness, pregnancy and medication being taken whilst filling out the registration form. If any of these change injury, illness, pregnancy or medication whilst being a member at The Yoga Shed, you will make us aware on my next visit and prior to undertaking any further classes.

5.6 You will notify the teacher immediately of any pain or major discomfort felt during class.

5.7 If at any point during the class you feel light headed or dizzy you must take rest. Only you are able to assess how you are feeling during exercise and it is important you monitor this, taking rest and drink when needed.

5.8 Hot Yoga is intensive exercise in a heated room and requires an appropriate level of fitness and health. You are strongly advised to consult your doctor prior to undertaking any classes.

5.9 All injuries, medical issues and medication are to be made clear on your first visit. The Yoga Shed must be kept up to date with any medical or health issues. ( including being under or over weight, falling pregnant, nursing, recent operations, high or low blood pressure)

5.10 When a member attends a class, it is in the knowledge they are in physically good condition and know no medical or other reason why it would be detrimental to their health.

5.11 Classes can require intensive levels of fitness, especially in the heated studio. It is the members responsibility to familiarise themselves with the style of class they are attending and the ability or level of practice necessary.

5.12 Please use a towel if you are borrowing one of our mats. We have special sticky dot yoga towels for sale in our shop.

5.13 The Yoga Shed staff are not medically trained and are therefore not qualified to assess whether a member is in a good physical condition or whether taking part in a class will be detrimental to their health.

5.14 Members are advised to seek medical advice before attending a class . This includes those with low/high blood pressure or cardiac irregularities. The Yoga Shed reserves the right to refuse a member entry to the class if they believe it could be detrimental to their health and safety.

5.15 Members should notify staff if there are any issues that mean yoga or hot yoga may have an effect on their health.

5.16 If a member believes their practice is having a detrimental effect on their health they should seek medical advice immediately.

5.17 A member should not enter the studio if they have any infections, contagious illnesses or diseases.

5.18 Members should follow the teacher’s instructions at all times to ensure their practice is as safe as possible.

5.19 Ultimately your health is your responsibility and you participate at your own risk.

6. LIMITATIONS OF LIABILITY

6.1 The Yoga Shed, nor its employees or agents shall be responsible for any loss, damage or theft of property, including bicycles left outside of the studio by you or your guest.

6.2 All vehicles and bikes parked or locked outside of our premises are left at the owner’s risk and The Yoga Shed cannot be held responsible.

6.3 The Yoga Shed cannot be held responsible for any personal injury, illness or, in the worst circumstance death which happens on our premises or as a result of our facilities or services provided.

6.4 The Yoga Shed cannot be held responsible if classes, teachers or equipment are not available or for any changes which are made to classes or teachers last minute or without notice.

6.5 Without prejudice to the conditions set out in section 5, it is your responsibly to ensure you are in the appropriate physical and mental condition to participate in a class or operate equipment. If in doubt it is your responsibility to ask a member of staff for help.

6.6 We provide lockers and advise members to lock all valuables away. However, personal belongings brought on to the premises are done so at your own risk. The Yoga Shed does not accept liability for any loss or damage of those personal items howsoever occassioned.

6.7 We do not accept any liability in connection with any third party websites which may be linked or accessible through our own site, and we do not approve or endorse the content of such sites.

7. CLASSES

7.1 You understand that if you are late for any class, you may not be able participate out of consideration for other participants in the class and the teacher as well as your safety (as warm up is an important aspect of the class) If you sign up for the waiting list you will automatically be added in to the class if another person makes a cancellation.

7.2 If The Yoga Shed cancels a class we will credit your account with a class but no refund is available.

7.3 All shoes should be left in the provided storage by reception. No shoes should be worn in either studio or upstairs.

7.4 You must, at all times, be respectful of other students, their space and be considerate to those relaxing in the studio before class starts and when the class finishes.

7.5 Please don’t take any personal items, including phones into the studio. We provide lockers so you can safely store your valuables. You should only need a mat, towel/s and water.

7.6 We would suggest you avoid wearing any jewellery or watches during class.

7.7 Please keep body and feet clean when coming to the studio and as a courtesy to fellow students, please avoid wearing any heavy perfumes.

7.8 Smoking is not allowed in any part of The Yoga Shed’s premises. We also request that smokers refrain from smoking just before class. You may find you want to change your clothing before class as all odours are enhanced in the heated room.

8. USE OF FACILITIES FOR CHILDREN

8.1 No person under the age of 18 are permitted to attend classes without a signed parental declaration or being accompanied by an adult..

8.2 16-18 year olds are permitted to attend the adult classes with a parent accompanying them.

8.3 Under 16’s must attend the children/teen classes

8.4 You are responsible for the behaviour and health and safety of any child accompanying you.

9. GENERAL

9.1 You must use the main door to enter and exit the studio.

9.2 Members must report to reception before attending each class.

9.3 A suitable towel must be used when borrowing one of The Yoga Shed’s mats.

9.4 In the event of a fire members must follow all instructions of staff members of The Yoga Shed. They must use the nearest exit available, leaving all belongings behind.

9.5 You must wear appropriate dress for class, generally lighter clothes are best or those designed for sport. Members should be barefoot in both studios and before going upstairs. Socks, slippers and indoor flip-flops are permitted in and around the studio. However, when you practise we request you have bare feet.

9.6 Members must observe the guidelines and studio etiquette provided. Members may be reminded of these guidelines when necessary, to ensure everyone has a safe and pleasant visit.

9.7 By coming on to The Yoga Shed premises you consent to having your photograph taken and being videoed from time to time. These may be used for social media or marketing purposes. If you do not want your photograph taken, please notify The Yoga Shed in writing.

9.8 Members must notify The Yoga Shed of any changes of address, email address or phone number. If these changes aren’t made The Yoga Shed will presume that all communications have been received.

9.9 You agree to notify The Yoga Shed if there is an unauthorised use of your Mindbody account or any other breach of security, but you are responsible for the confidentiality of your account and passwords.

9.10 Any abuse of the Mindbody online system will result in your membership being terminated.

9.11 The Yoga Shed will communicate by email. By giving us your email you give us consent to communicate with you in this way.

9.12 The Yoga Shed reserves the right to refuse admission to the studio.

9.13 Unless informed otherwise by giving us your email address you agree to receive our monthly newsletter.

9.14 Any marketing, educational documents, website content, logo, pictures or other materials produced by The Yoga Shed remain the property of The Yoga Shed.

9.15 If The Yoga Shed choose to waive any breach of these Terms and Conditions. This does not stop them following these Terms sand Conditions at a later date.

9.16 (or any part of them)

9.17 and Conditions we each submit to the exclusive jurisdiction of the English Courts.

10. DATA PROTECTION

10.1 Data Protection Act 1998, any of your personal information is your personal property and, as such, we realise this places serious responsibility on us. Any personal information that is given to us will be collected, stored and used in accordance with our Privacy Policy.

10.2 Please read our Privacy Policy, which is on a separate web page.

10.3 While we take all precautions to ensure your personal information is kept safe we, cannot be held responsible for any unauthorised access.
